ORDER 7

WHEREAS, this matter came on for consideration upon the Court’s own 8

motion to require the recording of all civil proceedings in metropolitan court for 9

which that court is a court of record; 10

WHEREAS, this Court has superintending control over all inferior courts 11

under Article VI, Section 3 of the New Mexico Constitution, which confers upon 12

this C ourt the power to, among other things, “control the course of ordinary 13

litigation in inferior courts, ” Kerr v. Parson, 2016 -NMSC-028, ¶ 16, 378 P.3d 1, 14

and “regulate and promulgate rules regarding the pleadings, practice, and 15

procedure affecting the judici al branch of government,” Hudson v. State, 1976-16

NMSC-084, ¶ 4, 89 N.M. 759, 557 P.2d 1108; and 17

WHEREAS, the Court having considered the foregoing and being 18

sufficiently advised, Chief Justice C. Shannon Bacon, Justice Michael E. Vigil, 19

Justice David K. Tho mson, Justice Julie J. Vargas, and Justice Briana H. Zamora 20

concurring; 21

NOW, THEREFORE, IT IS ORDERED that beginning February 10, 2023, 1

every civil proceeding in the metropolitan court for which that court is a court of 2

record shall be recorded, regardless of the whether a party requests it, and 3

notwithstanding the language in Rule 3-708 NMRA providing that proceedings 4

will only be recorded if requested. 5
