ORDER 8

WHEREAS, this matter having come before the Court upon 9

recommendation to implement the statewide use of the instant judgment and 10

sentence form by district courts, and the Court having considered the 11

recommendation and being sufficiently advised; Chief Justice Michael E. Vigil, 12

Justice Barbara J. Vigil, Justice Judith K. Nakamura, Justice C. Shannon Bacon, 13

and Justice David K. Thomson concurring; 14

NOW, THEREFORE, IT IS ORDERED that the recommendation is 15

ACCEPTED and the use of the instant judgment and sentence form maintained by 16

the Administrative Office of the Courts shall be implemented on a statewide basis 17

by district courts on or before August 1, 2020; 18

IT IS FURTHER ORDERED that, if a district court does not have adequate 19

staff for the real-time use of the instant judgment and sentence form in the 20

courtroom during a sentencing hearing, a district court may use the instant 21

judgment and sentence form to prepare a form of judgment and sentence upon 22

1 review of the record from the sentencing hearing, which shall be issued within two

2 (2) business days of the conclusion of the sentencing hearing for review and

3 approval by counsel;

4 IT IS FURTHER ORDERED that the Administrative Office of the Courts

5 shall maintain a standard operating procedure for use of the instant judgment and

6 sentence form by the district courts; and

7 IT IS FURTHER ORDERED that the Administrative Office of the Courts

8 shall provide training and support to all district courts for use of the instant

9 judgment and sentence form.
