AMENDED ORDER 9

WHEREAS this matter came on for consideration by the Court upon the 10

request of the Fifth and Ninth Judicial Districts for the implementation of an 11

exploratory pilot program for e-filing in criminal cases i n the magistrate courts in 12

those districts; 13

WHEREAS, the Court concludes that magistrate and metropolitan courts in 14

all judicial districts would benefit from e-filing in criminal cases; 15

WHEREAS, the Court being desirous of increasing efficiency and accuracy 16

in the processing of criminal cases in New Mexico’s magistrate and metropolitan 17

courts to improve judicial economy and ensure the timely administration of justice; 18

and 19

WHEREAS, Supreme Court Order No. S -1-AO-2024-00023 dated May 20

20,2024, permitted an exploratory pilot project for electronic filing in criminal cases 21

in the magistrate courts of the Fifth and Ninth Judicial Districts only, and the Court 22

having considered the foregoing and being sufficiently advised, Chief Justice David 1

K. Thomson, Justice Michael E. Vigil, Justice C. Shannon Bacon, Justice Julie J. 2

Vargas, and Justice Briana H. Zamora concurring; 3

NOW, THEREFORE, IT IS ORDERED that the exploratory pilot program 4

for e-filing in criminal cases in the magistrate courts in the Fifth and Ninth Judicial 5

Districts is hereby extended to all Judicial Districts and extends to e-filing of 6

documents filed subsequent to the initial charging document (hereinafter "e-filing in 7

criminal cases"); 8

IT IS FURTHER ORDERED that the court executive officer s, court 9

managers, and court clerks of each Judicial District Court and the Bernalillo County 10

Metropolitan Court shall, in coordination and consultation with the Administrative 11

Office of the Courts, develop and implement a program analogous to Rules 2- 205 12

and 3-205 NMRA and consistent with Rules 6-211 and 7-211 NMRA and all other 13

applicable laws and Supreme Court rules, including any local rules for each court; 14

IT IS FURTHER ORDERED that e-filing in criminal cases in the magistrate 15

and metropolitan courts shall be made available to all attorneys beginning August 16

23, 2024; 17

IT IS FURTHER ORDERED that e-filing in criminal cases in the magistrate 1

and metropolitan courts shall be mandatory for attorneys beginning October 14, 2

2024; and 3

IT IS FURTHER ORDERED that the Rules of Criminal Procedure for State 4

Courts Committee shall consider whether to propose new rules analogous to Rules 5

2-205 and 3-205 NMRA to carry out the terms of this order and whether to 6

recommend the formal adoption of this pilot program under those rules. 7
