IMMEDIATE TEMPORARY SUSPENSION AND OTHER INTERIM
RELIEF.
The Commission may petition the Supreme Court for immediate temporary suspension as
follows:
A. Good Cause. If a complaint alleges or an investigation reveals that:
(1) Continued service of a judge is causing:
(a) Immediate and substantial harm to the public, to those with whom
the judge interacts in an official capacity, or to the orderly administration of justice; and/or
(b) Erosion of public confidence in the independence, integrity or
impartiality of the judiciary, or in the orderly administration of justice.
(2) Other good cause exists; and that the judge’s conduct may violate the
Code or otherwise may be grounds for discipline, removal, or retirement.
B. Petition. The Commission may petition the Supreme Court for immediate
temporary suspension of the judge with or without pay or for other interim relief. The petition
shall be filed under seal and shall set forth in full the factual and legal bases for the Supreme
Court to issue a summary order, and shall contain all documents and other evidence supporting
the allegations of the petition. The petition and accompanying evidence of factual and legal
grounds shall, as appropriate, comply with the Supreme Court Rules Governing Review of
Judicial Standards Commission Proceedings.
C. Service. The judge shall promptly be served with a copy of the petition.
D. Grounds Not Continuing. If, after filing of the petition, the grounds for an
immediate temporary suspension or other interim relief no longer exist, the Commission shall
promptly notify the Supreme Court and the judge.
E. Proceedings Continue. Proceedings before the Commission shall continue
during any period of suspension or other interim relief, and following any subsequent
reinstatement of a judge or vacation of other interim relief.
