PROCEDURE

FOR FILING AN APPLICATION FOR JUDICIAL AUTHORIZATION

TO OBTAIN A MARRIAGE LICENSE AND REQUEST FOR HEARING

1. Prepare an Application for Judicial Authorization to Obtain a Marriage License, Request for

Hearing, and Notice of Hearing. Prepare an original set of documents plus three (3) sets of

copies of each form.

2. Prepare three (3) stamped and addressed envelopes (4 x 9 or # 10). Two (2) envelopes should

be stamped and addressed to the opposing party (or his/her Attorney) and one (1) envelope

addressed to you.

3. File your documents: Submit a $132.00 filing fee (in the form of cash, credit/debit card, a

money order, or cashier’s check made payable to District Court Clerk; no personal checks or

American Express accepted) with your original documents, copies and envelopes to the Civil

Clerk’s Office, Room 119, Second Judicial District Court, 400 Lomas Blvd. NW, Albuquerque,

NM between the hours of 8:00 A.M. - 4:00 P.M., Monday - Friday. Contact the division at

(505)841-7438 prior to filing to confirm hours.

4. The Clerk will file the original documents, endorse stamp your copies, and return two (2) sets

of copies to you. One set of copies is for your records and the other set is for the other party.

Mail or deliver an endorsed copy of the Application for Judicial Authorization to Obtain a

Marriage License and an endorsed copy of the Request for Hearing to the other party. It is your

responsibility to notify the opposing party that you have requested a hearing.

5. The assigned judge’s secretary will send a scheduled Notice of Hearing to all parties in the

envelopes provided by you. This notice will inform you of the hearing date and time.

6. Since the other party will not be able to attend the hearing in the courthouse, they may need to

file a Motion for Telephonic Appearance when they receive the Notice of Hearing.
