Certification of readiness prior to pretrial conference or docket call
Both the
prosecutor and defense counsel shall submit a certification of readiness form five (5) days before
the final pretrial conference or docket call, indicating they have been unable to reach a plea
agreement, that both parties have contacted their witnesses and the witnesses are available and
ready to testify at trial, and that both parties are ready to proceed to trial. This certification may
be by stipulation. If either party is unable to proceed to trial, it shall submit a written request for
extension of the trial date as outlined in Paragraph K of this rule. If the state is unable to certify
the case is ready to proceed to trial and does not meet the requirements for an extension in
Paragraph K of this rule, it shall prepare and submit notice to the court that the state is not ready
for trial and the court shall dismiss the case.
