A. Qualifications and Duties of Chief Clerk

(1) The qualifications for appointment to the position of chief clerk

of the Court of Appeals shall be in accordance with the NMJB

Personnel Rules.

(2) The chief clerk shall perform those duties specified in the job

description for such office, required by law, and as delegated by

the judges and/or the chief judge. The chief clerk shall supervise

the employees of the clerk’s office.

(3) The chief clerk of the Court shall collect fees in accordance with

law and shall pay all fees and costs to the State Treasurer as

directed in NMSA 1978, Section 34-5-6 (2003) and NMSA

1978, Section 6-10-1 to -4 (1903, as amended through 2013).

(4) The chief clerk of the Court shall maintain information indicating

the amount of all monies received, the number of cases receiving

free process, and the disposition of any monies received.

(5) The chief clerk or designee shall review requests for extension of

time and are authorized to grant extensions of time to file a brief-

in-chief, answer brief, reply brief, docketing statement,

memorandum in opposition, request for exhibits, motion for

rehearing, or similar motions in their discretion. The chief clerk

is authorized to deny any such motions that do not comply with

appellate rules or the Court’s policies. Denials of such motions

on their merits shall be acted upon by the calendaring judge. The

chief clerk is also given authority to act on motions to withdraw

or substitute counsel on appeal or to appoint counsel in children’s

court and civil cases, motions for free process, motions to

supplement the record, and other miscellaneous motions.

(6) In any case in which the judges agree to hold oral argument, the

authoring judge will tell the chief clerk or designee the times and

dates the panel is available, and the chief clerk shall schedule and

send notice of oral arguments as directed. If an oral argument is

to be vacated, the authoring judge shall request the chief clerk to

prepare an order vacating and/or rescheduling the argument, and

the authoring judge’s chambers will notify the participating

judges’ chambers.

(7) The chief clerk or designee shall maintain information showing

the amount of monies expended by the Court during each month

and the balance, if any, remaining in each category of the Court

budget.

(8) The chief clerk shall maintain a monthly record of appeals filed,

case dispositions, and other Court statistical information as

directed by the chief judge.

B. Succession Plan

(1) The chief clerk will determine how to redistribute their case

management responsibilities and/or reassign their duties upon

leaving the Court. If the chief clerk leaves before making such

determination, the chief judge, in collaboration with the clerk’s

office management when appropriate, will redistribute the chief

clerk’s case management responsibilities and/or reassign their

duties.
