N.C.P.I.—Crim. 271.28B

UNLAWFULLY [BUYING] [SELLING] [ISSUING] [POSSESSING] AN [INSPECTION STICKER] [ELECTRONIC INSPECTION AUTHORIZATION]. FELONY.

The defendant has been charged with unlawfully [buying] [selling]

[issuing] [possessing] an [inspection sticker] [electronic inspection

authorization].

For you to find the defendant guilty of this offense, the State must

prove three things beyond a reasonable doubt.

First, that on or about the alleged date, the defendant [bought]

[sold] [issued] [possessed] an [inspection sticker] [electronic inspection

authorization].

Second, that the defendant did so without

a. [being properly licensed1 as an [inspection station] [self-inspector2] [inspection mechanic] and had not obtained in the

course of business authorization from the North Carolina

Division of Motor Vehicles through an electronic authorization

vendor]

b. [a vehicle inspection for which the vehicle had [passed the

inspection] [received a waiver]].

And Third, that the defendant did so knowingly.

If you find from the evidence beyond a reasonable doubt that on or

about the alleged date, the defendant knowingly [bought] [sold] [issued]

[possessed] an [inspection sticker] [electronic inspection authorization],

and that defendant did so without [being properly licensed as an

[inspection station] [self-inspector] [inspection mechanic] and had not

obtained in the course of business authorization from the North Carolina

Division of Motor Vehicles through an electronic authorization vendor] [a

vehicle inspection for which the vehicle had [passed the inspection]

[received a waiver]], it would be your duty to return a verdict of guilty. If

you do not so find or have a reasonable doubt as to one or more of these

things, it would be your duty to return a verdict of not guilty.
