N.C.P.I.—Civil 735.30
ACTION FOR SERVICES RENDERED A DECEDENT - ISSUE OF RECOVERY- BENEFITS OR OFFSETS.
The defendant has offered evidence tending to show that the
plaintiff received benefits (describe alleged benefits) from the decedent
in amounts which equal or offset part of the value of any services
rendered by the plaintiff. If the plaintiff satisfies you by the greater
weight of the evidence that he has rendered services and you determine
the fair market value of those services, but you find that the plaintiff
received benefits from the decedent arising out of the agreement
between them, you will determine the reasonable fair market value of
these benefits and offset that value against the reasonable fair market
value of the services rendered in arriving at your answer to this issue.1
