Issues in Criminal Destruction of or Tampering with Communication Device

To convict the Defendant of criminal destruction of or tampering with a communication device, the State must prove the following elements:

1. That the Defendant destroyed or tampered with a [telephone] [communication device];

AND

2. That the Defendant did so to obstruct, prevent or interfere with [the report to any law enforcement agency of any actual criminal offense] [the report to any law enforcement agency of any actual bodily injury or property damage] [a request made to any governmental agency or to any hospital, doctor, or other medical provider for necessary ambulance or emergency medical assistance];

AND

3. That the Defendant acted purposely or knowingly.

If you find from your consideration of the evidence that all of these elements have been proved beyond a reasonable doubt, then you should find the Defendant guilty.

If, on the other hand, you find from your consideration of the evidence that any of these elements has not been proved beyond a reasonable doubt then you should find the Defendant not guilty.
