Miss. R. Crim. P. 26.7
Consecutive or Concurrent Sentences
Unless otherwise provided by law, the court may direct that the sentence being
imposed will be served concurrently with, or consecutively to, any other
sentence previously or simultaneously imposed upon the defendant by any court.
When sentencing orders are silent, sentences shall run concurrently.
History
Comment: Rule 26.7 is based generally on Mississippi Code Section 99-19-21. The Rule is intended to encompass multiple charges arising from the same criminal episode, unrelated offenses for which sentence is imposed at one time, and a sentence imposed while the defendant is serving a sentence in Mississippi or elsewhere for another offense. Unless the sentencing order specifies otherwise, sentences shall run concurrently. See Shinn v. State, 74 So. 3d 901 (Miss. 2011) (citing Anderson v. State, 288 So. 2d 852 (Miss. 1974)).
