Receiving a Bribe by a Witness
[Name of defendant] is charged in count ____ with receiving a bribe.
If you find beyond a reasonable doubt from the evidence in this case that:
1. On or about [date of alleged crime], in ____________ County;
2. [Name of defendant] was a witness or a person who may have been called to be a witness in an
official proceeding; and
3. [Name of defendant] [intentionally/knowingly] and unlawfully [asked
for/solicited/accepted/agreed to accept] ____________ [specify the benefit], understanding that
_________________________ [specify (1) [name of defendant]’s testimony would be
influenced; (2) [name of defendant] would be encouraged to avoid the summons to testify; or (3)
[name of defendant] would be encouraged not to attend a proceeding that [he/she] had been
summoned to attend],
then you shall find [name of defendant] guilty as charged.
If the State did not prove any one of the above listed elements beyond a reasonable doubt,
then you shall find [name of defendant] not guilty of count _____.
