Proposed Mississippi Plain Language Model Jury Instructions - Criminal 2709
Lesser-Included Offense of Murder to Capital Murder
If you find that the State did not prove any one of the elements of capital murder, then
you must find [name of defendant] not guilty of capital murder. You will then proceed with your
deliberations to decide whether the State has proved beyond a reasonable doubt all of the
elements of the lesser crime of murder.
If you find beyond a reasonable doubt from the evidence in this case that:
A. [Elements of felony];
B. [Elements of felony]; and
C. [Elements of felony],
then you shall find [name of defendant] guilty of murder.
If the State did not prove any one of the above listed elements beyond a reasonable doubt,
then you shall find [name of defendant] not guilty of murder.
