Possessing a Controlled Substance with Intent to Sell or Distribute to a Minor
[Name of defendant] is charged in count ___ with possessing ______________ [specify
the controlled substance] intending to [sell/barter/transfer/manufacture/distribute/dispense] to a
person less than 21 years old.
If you find beyond a reasonable doubt from the evidence in this case that:
1. On or about [date of alleged crime], in ____________ County;
2. [Name of defendant] was 21 years old or older; and
3. [Name of defendant] [intentionally/knowingly] and unlawfully possessed __________ [specify
the controlled substance], intending to [sell/barter/transfer/distribute/dispense] the _________
[specify the controlled substance] to [name of person less than 21 years of age], who was less
than 21 years old,
then you shall find [name of defendant] guilty as charged.
If the State did not prove any one of the above listed elements beyond a reasonable doubt,
then you shall find [name of defendant] not guilty of count ___.
