Damages - Real Property - Before and After Rule

In determining the amount to award the [plaintiff/landowner] for damage to [his/her/its]

real property, you should consider the difference in the fair market value of the real property

immediately before it was damaged and the fair market value of the real property immediately

after it was damaged. If the real property can be repaired or restored to its original condition, but

the reasonable costs would be more than what the fair market value of the real property was

before it was damaged, then you should award the plaintiff the difference between the fair market

value of the real property immediately before the damage and the fair market value of the real

property immediately after the damage occurred.
