PRIVILEGED MATTER DISCLOSED UNDER COMPULSION OR WITHOUT OPPORTUNITY TO CLAIM THE PRIVILEGE

A privilege is not waived by a disclosure that was:

(a) Compelled erroneously; or

(b) Made without opportunity to claim the privilege.
