IN THE COURT OF APPEALS OF MARYLAND

ADMINISTRATIVE ORDER ON

PROTOCOLS AND IMPLEMENTATION OF AN

ELECTRONIC OFFICIAL RECORD OF DECISIONS OF THE COURTS OF APPEAL

WHEREAS, The Maryland Uniform Electronic Legal Materials Act (MUELMA),

codified as Code, State Government Article, Sections 10- 1601 through 10-1611, effective

October 1, 2017, addresses the electronic publication of state legal materials, including

requirements for authentication, preservation, and security thereof; and

WHEREAS, Maryland Rule 1-105, recently adopted by this Court to take effect on

July 1, 2018, provides the procedure by which the Court of Appeals shall ensure the

authenticity, preservation, and security of decisions of the Court of Appeals and the Court

of Special Appeals should the Court of Appeals determine that decisions that are published

electronically are the official record of each Court; and

WHEREAS, Maryland Rule 1-105(c)(2) requires the Administrative Office of the

Courts to develop protocols that comply with the requirements of Code, State Government

Article, Title 10, Subtitle 16, to ensure the authenticity, preservation, and security of

decisions and submit the protocols for consideration by the Court; and

WHEREAS, the Court, having considered the protocols submitted by the

Administrative Office of the Courts through the State Court Administrator and having been

satisfied that the protocols comply with the statutory requirements,

NOW, THEREFORE, it is ORDERED, by the Court of Appeals of Maryland, this

10th day of April, 2018, that the protocols proposed by the Administrative Office of the

Courts are hereby approved and shall be implemented no later than September 1, 2018, on

which date henceforth, for the Court of the Appeals and the Court of Special Appeals, the

official record of a decision in a Maryland Electronic Court (MDEC) action shall be the

electronically published decision.
