Ky. Sup. Ct. Order 2024-42 E
Any defendant charged with a DUI 1st offense which causes an accident
resulting in death or serious physical injury as defined in KRS 500.080 is
not eligible under this schedule. This provision only applies to any DUI
accident where the citation indicates someone, other than a defendant, was
transported to the hospital by ambulance due to the accident.
