ORDER
IN RE: LIMITED EXCEPTION TO MANDATORY ELECTRONIC FILING
IN CHILD SUPPORT IV-D CASES
On June 13, 2023, the Supreme Court entered Administrative Order
2023-21, Mandatory Electronic Filing in Selected Case Types in the Circuit and
District Courts of the Commonwealth, which mandated electronic filing in
certain domestic relations cases, effective August 1, 2023. The Cabinet for
Health and Family Services (CHFS) notified the Court that, because of staffing,
funding and technology limitations, it was unable to electronically file
documents on behalf of the Commonwealth in cases involving child support
enforcement pursuant to Title IV-D of the Social Security Act. CHFS requested
and the Court granted a six-month extension of the electronic filing mandate to
address these constraints.
The Supreme Court recently received notice from the Kentucky County
Attorneys Association that, despite efforts to troubleshoot implementation
issues, additional technological barriers are preventing successful electronic
filing of Title IV-D cases. The Association has requested an additional six-month extension to allow time for all County Attorneys to comply with
electronic filing requirements.
Accordingly, under Section 116 of the Kentucky Constitution and the
Administrative Rules of Practice and Procedure for the Kentucky Court of
Justice Electronic Filing, the Court hereby ORDERS a limited exception to
Administrative Order 2023-21 to allow for a six-month extension on
electronically filing documents on behalf of the Commonwealth in cases
involving child support enforcement pursuant to Title IV-D of the Social
Security Act. Title IV-D cases may be filed conventionally until August 1, 2024.
This Order shall be effective February 1, 2024.
