Ky. Sup. Ct. Order 2023-40 I
Any defendant charged with one of the following offenses during a natural or
man-made disaster defined by KRS 500.080, or during a period of civil
unrest/riot as defined by KRS 525.010, is not eligible under this schedule:
1. KRS 508.025 (Assault in the third degree)
2. KRS 511.040 (Burglary in the third degree)
3. KRS 511.060 (Criminal Trespass in the first degree)
4. KRS 511.070 (Criminal Trespass in the second degree)
5. KRS 511.080 (Criminal Trespass in the third degree)
6. KRS 512.020 (Criminal Mischief in the first degree)
7. KRS 512.030 (Criminal Mischief in the second degree)
8. KRS 512.040 (Criminal Mischief in the third degree)
9. KRS 514.030 (Theft by Unlawful Taking)
10. KRS 514.040 (Theft by Deception)
11. KRS 514.110 (Receiving Stolen Property)
12. KRS 525.020 (Riot in the first degree)
13. KRS 525.030 (Riot in the second degree)
14. KRS 525.040 (Inciting to riot)
