Limited Exception to Mandatory Electronic Filing in Child Support IV-D Cases

ORDER
IN RE: LIMITED EXCEPTION TO MANDATORY ELECTRONIC FILING IN
CHILD SUPPORT IV-D CASES
On June 13, 2023, the Supreme Court entered Administrative Order
2023-21, Mandatory Electronic Filing in Selected Case Types in the Circuit and
District Courts of the Commonwealth, which mandated electronic filing in
certain domestic relations cases, effective August 1, 2023. The Cabinet for
Health and Family Services (CHFS) has notified the Court that, because of
staffing, funding and technology limitations, currently unable to file documents
on behalf of the Commonwealth in cases involving child support enforcement
pursuant to Title IV-D of the Social Security Act. CHFS has requested a six-month extension of the electronic filing mandate to address these constraints.
The Supreme Court has reviewed the request submitted on behalf of
CHFS and agrees that an extension is reasonable. Accordingly, under Section
116 of the Kentucky Constitution and the Administrative Rules of Practice and
Procedure for the Kentucky Court of Justice Electronic Filing. the Court hereby
ORDERS that the Cabinet for Health and Family Services is granted a limited
exception to Administrative Order 2023-21 to allow for a six-month extension
on electronically filing documents on behalf of the Commonwealth in cases
involving child support enforcement pursuant to Title IV-D of the Social
Security Act. Title IV-D cases may be filed conventionally until February 1,
2024.
This Order shall be effective August 1, 2023, nunc pro tunc.
