Correcting Typographical Errors in Administrative Orders 2022-58, 2022-59, and 2022-65

In Re: Correcting Typographical Errors in Administrative Orders

2022-58, 2022-59, and 2022-65

I. Section III(3)(c), FCRPP 39(3), of Administrative Order 2022-58 is

hereby corrected as follows:

(3) The parties may agree to mediate one or more issues in an action with a

mediator or mediation service of their choice. If the parties are unable to

agree on a mediator or a mediation service within fifteen (15) days of being

referred to mediation, the court may choose a private mediator, private

mediation service, or a Kentucky Court of Justice employee. Any mediator

chosen by the court must be qualified under subsection (5) of this rule and

must agree to conduct the mediation.

II. Section 10(2) of Administrative Order 2022-59 is hereby corrected as

follows:

Section 10. Accounting of Master Commissioners

(2) Annual Accounting Report. Each master commissioner shall provide to

the Administrative Office of the Courts, Department of Financial Services,

on or before March 1st of each year, a complete accounting of the prior

calendar year for all fees collected and for all expenses deducted. The

accounting shall be reported on a form prescribed by the Administrative

Office of the Courts. The report shall contain, at a minimum, the following

information:

(a) Name (printed);

(b) Address;

(c) County and Circuit;

(d) Total income received (fees, commissions and other income including

interest);

(e) Fees retained from previous year for three months estimated expense;

(f) Expenses as provided in Subsection (3) herein below;

(g) Master commissioner salary cap;

(h) Notarized signature of master commissioner;

(i) Signature of approving circuit judge.

III. Section 8(1) of Administrative Order 2022-65 is hereby corrected as

follows:

Section 8. Electronic Filing in District and Circuit Courts

(1) In order to become an eFiler in a supported action, the eFiler must

electronically file an Entry of Appearance or any other supported

document in that case, or the eFiler may use a supported feature for the

purpose of opting into cases. Registering as an eFiler does not

automatically opt an eFiler into the eFiler’s other existing cases.

Registration is not complete until the clerk transmits a Notification of

Court Processing accepting the filing. Electronic service through the

eFiling system will not be made on parties associated with the case who

are not registered eFilers.

IV. Sections 17-19 of Administrative Order 2022-65 are hereby

renumbered as Sections 17-20 as follows:

Section 17. Fees, Costs, and Payment Methods

Section 18. Retention Requirements

Section 19. Technical Difficulties; System Unavailability

Section 20. Technical Assistance

This Order shall be effective upon entry, and until further Order.
