Ky. Sup. Ct. Order 2020-73 § 31

(1) As provided by KRS 23A.200 and 24A.170, the jury fee for civil cases in

circuit and district court is set in accordance with CR 3.02 and 3.03.

(2) The jury fee in civil cases shall be paid at the time the request for a jury

trial is made, and shall be paid by the party making the request. If two or

more cases are consolidated and tried together, the clerk shall collect

only one jury fee. A party who is proceeding in forma pauperis shall not

be liable for a jury fee.

(3) The clerk shall place the jury fee in an escrow account. If the request for

a jury trial is withdrawn or the case is disposed of at least two court days

prior to the date set for trial, the amount of the jury fee shall be refunded

to the person paying it. Otherwise, it shall be placed in the general fund

of the state treasury, in the same manner as the filing fee.

(4) Unless the jury fee has been refunded as provided in subsection (3) of

this section, the amount of the jury fee shall be assessed as costs against

the unsuccessful party upon judgment or dismissal of the action.

This Order shall be effective upon entry and until further Order of this

Court.
