In the
Indiana Supreme Court
In the Matter of the Marion County
Expedited Mental Health Appeals Pilot
Project
Supreme Court Case No. 26S-MS-291
Order Extending the Marion County Expedited Mental Health
Appeals Pilot Project
On July 16, 2024, this Court issued an order establishing the Marion County Expedited
Mental Heath Appeals Pilot for a two-year term, commencing with cases filed on September 1,
2024. On September 2, 2025, following feedback from stakeholders involved in the project, this
Court issued an order modifying the Expedited Appeals Pilot Parameters as set forth in Exhibit
A to the July 16, 2024 order. The purpose of the Pilot Project is to use innovative technology to
overcome the challenges associated with the timelines of temporary mental health commitments
and appeals of such cases. The Pilot Project has been very successful in achieving that purpose.
Accordingly, the term of the Marion County Expedited Mental Health Appeals Pilot
Project is hereby EXTENDED until February 28, 2027. This extension will permit continued
use of the technology employed in the Pilot Project and continued application of the expedited
briefing schedule while the Court considers whether the Indiana Rules of Appellate Procedure
should be amended to incorporate the conditions set forth in Exhibit A to the September 2, 2025
order. Except as provided in this order, all terms governing the Pilot Project under the July 16,
2024 order, as modified by the September 2, 2025 order, shall remain in effect during the
extension period.
