Garnishment of Wages

The Court may set the amount of a wage garnishment at less than the maximum imposed by Ind.

Code § 24-4.5-5-105, if it determines that Defendant will be deprived of income necessary for

Defendant’s support and/or the support of those legally dependent on the Defendant. The Defendant

bears the burden of proving the above financial circumstances.

Comment: This provision is consistent with SCR 11(C), which authorizes the Court to specify the

method of payment when ordering a judgment.
