Verdict Form--Guilty But Mentally Ill of 2nd Degree Murder
In Set 27.04B, the defendant, Thomas Swanson, is charged with the first degree murder
of Henry Carter. The State's evidence shows that the two men had a verbal and physical
confrontation before the defendant stabbed Henry Carter 17 times with an ice pick. The
defendant puts forth an insanity defense, but does not testify. No defense witness testifies to the
events surrounding Carter's death. The court instructs the jury on second degree murder. The
court also instructs the jury on the guilty but mentally ill verdict.
