amended by P.A. 88-659, effective September 16, 1994</us>.

Give I

nstruction 16.08.

Section (

b) enhances the penalty from a Class 3 felony to a Class 2 felony when the

damage exceeds $300. Thus, give the bracketed phrase in the openi ng paragraph (“[exceeding

$300]”) when the amount of the damage is an issue. When the amount of the damage is an issue,

it should be resolved by the jury.

Use appl

P.A. 88-659, e
