Issues In Ritualized Abuse Of A Child
To sustain the charge of ritualized abuse of a child, the State must prove the following
propositions:
First Proposition: That the defendant [(intentionally) (knowingly) (recklessly)]
committed [any of] the following act[s] [(with) (upon) (in the presence of)] a child under 18
years of age:
[1] actually or in simulation, tortures, mutilates, or sacrifices any warm- blooded animal
or human being; and
[or]
[2] forces ingestion, injection, or other application of any narcotic, drug, hallucinogen, or
anesthetic for the purpose of dulling sensitivity, cognition, recollection of, or resistance to
any criminal activity; and
[or]
[3] forces ingestion, or external application, of human or animal urine, feces, flesh, blood,
bones, body secretions, nonprescribed drugs, or chemical compounds; and
[or]
[4] involves the child in a mock, unauthorized or unlawful marriage ceremony with
another person or representation of any force or deity, followed by sexual contact with
the child; and
[or]
[5] places the living child into a coffin or open grave containing a human corpse or
remains; and
[or]
[6] threatens death or serious harm to the child, the child's parents, family, pets, or friends
that instills a well-founded fear in the child that the threat will be carried out; and
[or]
[7] unlawfully dissects, mutilates, or incinerates a human corpse; and
Second Proposition: That the defendant did so as part of a ceremony, rite, or any similar
observance.
If you find from your consideration of all the evidence that each one of these propositions
has been proved beyond a reasonable doubt, you should find the defendant guilty.
If you find from your consideration of all the evidence that any one of these propositions
has not been proved beyond a reasonable doubt, you should find the defendant not guilty.
