Definition Of Criminal Transmission Of HIV (Human Immunodeficiency Virus)
A person commits the offense of criminal transmission of HIV when he, knowing that he
is infected with HIV,
[1] engages in intimate contact with another.
[or]
[2] [(transfers) (donates) (provides)] his [(blood) (tissue) (semen) (organs) (potentially
infectious body fluids)] for [(transfusion) (transplantation) (insemination) (administration)] to
another.
[or]
[3] [(dispenses) (delivers) (exchanges) (sells) (transfers)] nonsterile [(intravenous)
(intramuscular)] drug paraphernalia to another.
[It is not necessary that an infection with HIV actually result from that conduct.]
