Issue In Cruelty To Children

To sustain the charge of cruelty to children, the State must prove the following

proposition:

That the defendant wilfully and unnecessarily exposes to the inclemency of the weather

____, a[n] [(child) (apprentice) (person)] under his legal control.

[or]

That the defendant [(knowingly) (intentionally) (recklessly)] injured the [(health) (limb)

] of a[n] [(child) (apprentice) (person)] under his legal control.

If you find from your consideration of all the evidence that the State has proved this

proposition beyond a reasonable doubt, you should find the defendant guilty.

If you find from your consideration of all the evidence that the State has not proved this

proposition beyond a reasonable doubt, you should find the defendant not guilty.
