ICJI 309 DEFENDANT'S INTENT-MANIFESTED BY CIRCUMSTANCES
Comment
The committee recommends that no instruction be given stating that a defendant's intent can be inferred by the circumstances. This is a matter of argument to the jury.
Francis v. Franklin, 471 U.S. 307, 105 S.Ct. 1965, 85 L.Ed.2d 344 (1985), disapproved the presumption that a person intends the natural consequences of his/her act as improperly shifting the burden on a defendant in violation of the 14th Amendment.
