COMMITTEE ON THE IMPLEMENTATION OF RULES

PROMULGATED FOR CIVIL JUSTICE IMPROVEMENTS

ORDER ESTABLISHING THE COMMITTEE ON THE IMPLEMENTATION

OF RULES PROMULGATED FOR CIVIL JUSTICE IMPROVEMENTS

Following extensive work by the Task Force on Civil

Justice Improvements, on October 8, 2020 the Hawaii Supreme

Court promulgated amendments to Rules 3, 4, 12, and 12.1 of the

Rules of the Circuit Courts of the State of Hawaii (RCCH) and

adopted new RCCH Rules 12.1, 12.2, 12.3, and 15.1, and

promulgated amendments to Rules 16, 16.1, 26, and 29 of the

Hawaii Rules of Civil Procedure (HRCP), and adopted new HRCP

Rule 16.1. These new provisions were initially to take effect

on January 1, 2021.

Upon consideration, however, of the issues and

concerns that arose regarding the development of appropriate

measures for the implementation of these new provisions, on

November 5, 2020, the Hawaii Supreme Court extended the

effective date of the new provisions from January 1, 2021 to

July 1, 2021.

NOW, THEREFORE, in light of the delayed effective date

of the new measures, and to ensure a smooth implementation of

the aforementioned new rules,

IT IS HEREBY ORDERED as follows:

1. A Committee on the Implementation of Rules

Promulgated for Civil Justice Improvement (the Committee) is

hereby established, effective upon the filing of this order.

2. The purpose of the Committee is to review the new

rules set forth in the Hawaii Supreme Court’s October 8, 2020

orders amending the RCCH and the HRCP, intended to improve the

civil litigation process, and determine procedures and

guidelines to ensure and promote a smooth transition to those

new rules upon their effective date of July 1, 2021.

3. The following individuals are appointed to the

Committee:

The Honorable James H. Ashford

The Honorable Peter T. Cahill

The Honorable Jeannette H. Castagnetti

The Honorable Henry T. Nakamoto

The Honorable John M. Tonaki

The Honorable Randal G.B. Valenciano

4. The Honorable Jeannette H. Castagnetti shall

serve as Chair of the Committee, and may appoint additional

members as deemed necessary for the Committee’s work.
