Included Offense When Greater Offense is
ALTERNATIVELY CHARGED IN SEPARATE COUNTS: GENERIC
If and only if you find the Defendant, (defendant’s name),
not guilty of both of the alternatives of (charged offense) in
Counts (count numbers), or you are unable to reach a unanimous
verdict as to Counts (count numbers), or you find the Defendant
not guilty of one of the alternatives in Counts (count numbers)
and are unable to reach a unanimous verdict as to the other
alternative, then you must consider whether the Defendant is
guilty or not guilty of the included offense of (included
offense).
