Included Offense When Greater Offense is
ALTERNATIVELY CHARGED IN A SINGLE COUNT: GENERIC
If and only if you find the Defendant, (defendant’s name),
not guilty of both of the alternatives of (charged offense) in
Count (count number), or you are unable to reach a unanimous
verdict as to both of the alternatives, or you find the
Defendant not guilty of one of the alternatives and are unable
to reach a unanimous verdict as to the other alternative, then
you must consider whether the Defendant is guilty or not guilty
of the included offense of (included offense).
