NEGLIGENT DESIGN – ELEMENTS
To prevail on the claim of negligent design, plaintiff(s)
must prove both of the following elements:
1. The manufacturer of the product failed to take
reasonable measures to design its product to protect against a
reasonably foreseeable risk of injury; and
2. That failure was a legal cause of injury to
plaintiff(s).
