TRANSFERRED INTENT

activein force · 2026-07-29 – presentact-effective-date

If the defendant [or [his] [her] principal] intends to [hit] [strike] [shoot] a person, and in the process [hits] [strikes] [shoots] a different or unintended person, the law transfers the intent to [hit] [strike] [shoot] the intended person to any person who was actually [hit] [struck] [shot].

Give if applicable.

Under Florida law, mistaken identity of a person does not negate the doctrine of transferred intent.
