AGGRAVATION OF A CRIME WHEN COMMITTED BY AN UNAUTHORIZED ALIEN
§ 775.0848, Fla. Stat.
Give if the same jury that decided guilt on the underlying crime is determining in a bifurcated proceeding whether the defendant was an unauthorized alien.
Now that you have found (defendant) committed (insert crime[s]), you must also determine whether the State proved beyond a reasonable doubt that the defendant was an unauthorized alien at the time [he] [she] committed [that] [those] crime[s].
§ 908.111, Fla. Stat.
An “unauthorized alien” is a person who is unlawfully present in the United States according to the terms of the federal Immigration and Nationality Act.
