FRAUDULENT [SALE] [LEASE] OF REAL PROPERTY

§ 817.0311, Fla. Stat.

To prove the crime of Fraudulent [Sale] [Lease] of Real Property, the State must prove the following element beyond a reasonable doubt:

Give as applicable.

(Defendant)

a. listed or advertised real property for sale knowing that the purported seller had no legal title or authority to sell the property.

b. rented or leased real property to another person knowing that [he] [she] had no lawful ownership or leasehold interest in the property.
