TRESPASS ON THE CAMPUS OF A [STATE UNIVERSITY] [FLORIDA COLLEGE SYSTEM INSTITUTION] FOR THE PURPOSE OF THREATENING OR INTIMIDATING ANOTHER
§ 810.098, Fla. Stat.
To prove the crime of Trespass on the Campus of a [State University] [Florida College System Institution] for the Purpose of Threatening or Intimidating Another, the State must prove the following four elements beyond a reasonable doubt:
1. (Defendant) willfully entered the campus of a [state university] [Florida College System institution].
2. (Defendant) entered the campus with the purpose to threaten or intimidate [another person] [(name of person)].
3. (Defendant) was not authorized, licensed, or invited to enter the campus.
4. (Defendant) was warned by the [state university] [Florida College System institution] to depart and refused to do so.
“Willfully” means intentionally, knowingly, and purposely.
“To threaten or intimidate” means to put a reasonable person in fear of harm to his or her person or property.
“State university” includes (insert name of institution in § 1000.21(6), Fla. Stat.) [and any branch campuses, centers, or other affiliates of the institution].
“Florida College System institution” includes (insert name of institution in § 1000.21(3), Fla. Stat.) [and any branch campuses, centers, or other affiliates of the institution].
