DEFENSE ISSUES
If, however, the greater weight of the evidence supports (claimant’s) claim then you shall consider the defense[s] raised by (defendant).

Whether (defendant) had a [license] [privilege] [legal right] to [use] [enter onto] (claimant’s) property.
b. Necessity:
Whether (defendant’s) [use] [entry onto] (claimant’s) property occurred during an emergency situation, was reasonably necessary to prevent serious harm, and was done in a reasonable time and in a reasonable manner.
