Debt Adjusting
DEBT ADJUSTING
In order to find Defendant guilty of Adjusting a Debt, you must find the State
has proved the following three (3) elements beyond a reasonable doubt:
(1) Defendant was engaged in the debt-adjusting business;
(2) Defendant made an express or implied contract with a debtor, under which
the debtor agreed to make periodic monetary payments to Defendant; and
(3) Defendant distributed these payments among certain specified creditors
according to agreed upon plan for a fee or other benefit.
