Unauthorized Use of a Vehicle [During Maintenance]

UNAUTHORIZED USE OF A VEHICLE

In order to find Defendant guilty of Unauthorized Use of a Vehicle, you must

find the State has proved the following three (3) elements beyond a reasonable doubt:

(1) Defendant had possession of the vehicle to repair or maintain it, for

compensation, under agreement;

(2) Defendant intentionally used the vehicle for Defendant’s own purpose

without permission; and

(3) Defendant’s use of the vehicle was a gross deviation from the purpose of

the agreement.

“Intentionally” means it was Defendant’s conscious objective or purpose to use

the vehicle for Defendant’s own purpose.

“Gross deviation” means Defendant consciously did not follow a reasonable

standard of conduct, in the light of all the surrounding circumstances.
