Interference with Custody [Incompetent Person]
INTERFERENCE WITH CUSTODY [INCOMPETENT PERSON]
In order to find Defendant guilty of Interference With Custody, you must find
the State has proved the following two (2) elements beyond a reasonable doubt:
(1) Defendant took or enticed an incompetent person from the lawful custody
of another person or institution; and
(2) Defendant acted knowingly.
“Knowingly” means Defendant was aware Defendant had no legal right to
lawful custody of the incompetent person.
