Offensive Touching
OFFENSIVE TOUCHING
In order to find Defendant guilty of Offensive Touching, you must find the
State has proved the following three (3) elements beyond a reasonable doubt:
(1) Defendant touched [victim] with [saliva/urine/feces/any other bodily
fluid];
(2) Defendant knew Defendant’s actions were likely to cause offense or
alarm to [victim]; and
(3) Defendant acted intentionally.
“Intentionally” means it was Defendant’s conscious objective or purpose to
cause offense or alarm to [victim].
