Conspiracy in the First Degree
CONSPIRACY IN THE FIRST DEGREE
In order to find Defendant guilty of Conspiracy in the First Degree, you
must find the State has proved each of the following two (2) elements has been
established beyond a reasonable doubt:
(1) Defendant agreed with another person that one or more of them would
engage in conduct constituting a felony or an attempt to commit a felony; and
(2) Defendant acted intentionally.
“Intentionally” means it was Defendant’s conscious objective or purpose to
engage in the conspiracy.
