Conspiracy in the Third Degree
CONSPIRACY IN THE THIRD DEGREE
In order to find Defendant guilty of conspiracy in the third degree, you must
find the State has proved each of the following three (3) elements beyond a
reasonable doubt:
(1) Defendant agreed to aid another person in the planning or commission
of a misdemeanor, or an attempt to commit a misdemeanor;
(2) Either Defendant or the other person committed an overt act in pursuit of
this conspiracy; and
(3) Defendant acted intentionally.
“Intentionally” means it was Defendant’s conscious objective or purpose to
engage in the conspiracy.
An “overt act” is any act to pursue or advance the purpose of the conspiracy.
