Criminal Nuisance
CRIMINAL NUISANCE
In order to find Defendant guilty of Criminal Nuisance, you must find the
State has proved the following three (3) elements beyond a reasonable doubt:
(1) Defendant maintained [place];
(2) [place] was a place where persons gathered for the purpose of engaging
in unlawful conduct; and
(3) Defendant acted knowingly.
“Unlawful” means contrary to law or not permitted by law.
“Knowingly” means Defendant knew or was aware Defendant was
engaging in criminal nuisance.
