Competency, Mistaken Belief, Defective Swearing, Lack of Jurisdiction [No Defense in Perjury Prosecution]
COMPETENCY, MISTAKEN BELIEF, DEFECTIVE SWEARING,
OR LACK OF JURISDICTION [NO DEFENSE IN PERJURY
PROSECUTION]
It is not a defense to the charge of Perjury that:
(1) Defendant was not competent to make the false statements alleged; or
(2) Defendant mistakenly believed the false statement to be immaterial; or
(3) A document purportedly signed under oath and published or signed by
Defendant was not in fact made under oath; or
(4) Court in which the offense allegedly occurred lacked jurisdiction over
Defendant or over the subject matter.
