Seller’s Duty to Inspect
SELLER’S DUTY TO INSPECT
Generally, a seller is under no duty to inspect the products it sells. To find a
seller negligent, you must make two findings, that:
(1) the manufacturer was negligent in the [design / manufacture] of the
product; and
(2) [seller’s name] either had actual knowledge of a [negligent design /
manufacturing defect] in the product or had reason to believe that the product was
negligently [designed / manufactured].
