Duty of Care at an Uncontrolled Intersection
DUTY OF CARE AT AN UNCONTROLLED INTERSECTION
This accident occurred at an uncontrolled intersection. [Plaintiff’s name]
contends that [he/she] had the right of way. But even if you determine that [he/she]
had the right of way, the law requires motorists to keep a proper lookout for other
vehicles. A right of way is not absolute; it is only relative. Regardless of having the
right of way, a motorist must continuously exercise the due care required by the
situation in order to prevent injury to [himself/herself] and others.
